EXCLUSIVE: Career lawyers overruled on voting case

The incident - which gained national attention when it was captured on videotape and distributed on YouTube - had prompted the government to sue the men, saying they violated the 1965 Voting Rights Act by scaring would-be voters with the weapon, racial slurs and military-style uniforms.

Career lawyers pursued the case for months, including obtaining an affidavit from a prominent 1960s civil rights activist who witnessed the confrontation and described it as "the most blatant form of voter intimidation" that he had seen, even during the voting rights crisis in Mississippi a half-century ago.

The lawyers also had ascertained that one of the three men had gained access to the polling place by securing a credential as a Democratic poll watcher, according to interviews and documents reviewed by The Washington Times.

The career Justice lawyers were on the verge of securing sanctions against the men earlier this month when their superiors ordered them to reverse course, according to interviews and documents. The court had already entered a default judgment against the men on April 20.

A Justice Department spokesman on Thursday confirmed that the agency had dropped the case, dismissing two of the men from the lawsuit with no penalty and winning an order against the third man that simply prohibits him from bringing a weapon to a polling place in future elections.

The department was "successful in obtaining an injunction that prohibits the defendant who brandished a weapon outside a Philadelphia polling place from doing so again," spokesman Alejandro Miyar said. "Claims were dismissed against the other defendants based on a careful assessment of the facts and the law."

Mr. Miyar declined to elaborate about any internal dispute between career and political officials, saying only that the department is "committed to the vigorous prosecution of those who intimidate, threaten or coerce anyone exercising his or her sacred right to vote."

Court records reviewed by The Times show that career Justice lawyers were seeking a default judgment and penalties against the three men as recently as May 5, before abruptly ending their pursuit 10 days later.

People directly familiar with the case, who spoke only on the condition of anonymity because of fear of retribution, said career lawyers in two separate Justice offices had recommended proceeding to default judgment before political superiors overruled them.

Tensions between career lawyers and political appointees inside the Justice Department have been a sensitive matter since allegations surfaced during the Bush administration that higher-ups had ignored or reversed staff lawyers and that some U.S. attorneys had been removed or selected for political reasons.

During his January confirmation hearings, Attorney General Eric H. Holder Jr. said that during his lengthy Justice Department tenure, the career lawyers were "my teachers, my colleagues and my friends" and described them as the "backbone" of the department.

"If I am confirmed as attorney general, I will listen to them, respect them and make them proud of the vital goals we will pursue together," he said.

Justice officials declined to say whether Mr. Holder or other senior Justice officials became involved in the case, saying they don't discuss internal deliberations.

The civil suit filed Jan. 7 identified the three men as members of the Panthers and said they wore military-style uniforms, black berets, combat boots, battle-dress pants, black jackets with military-style insignias and were armed with "a dangerous weapon"and used racial slurs and insults to scare would-be voters and those there to assist them at the Philadelphia polling location on Nov. 4.

The complaint said the three men engaged in "coercion, threats and intimidation, ... racial threats and insults, ... menacing and intimidating gestures, ... and movements directed at individuals who were present to vote." It said that unless prohibited by court sanctions, they would "continued to violate ... the Voting Rights Act by continuing to direct intimidation, threats and coercion at voters and potential voters, by again deploying uniformed and armed members at the entrance to polling locations in future elections, both in Philadelphia and throughout the country."

To support its evidence, the government had secured an affidavit from Bartle Bull, a longtime civil rights activist and former aide to Sen. Robert F. Kennedy's 1968 presidential campaign. Mr. Bull said in a sworn statement dated April 7 that he was serving in November as a credentialed poll watcher in Philadelphia when he saw the three uniformed Panthers confront and intimidate voters with a nightstick.

Inexplicably, the government did not enter the affidavit in the court case, according to the files.

"In my opinion, the men created an intimidating presence at the entrance to a poll," he declared. "In all my experience in politics, in civil rights litigation and in my efforts in the 1960s to secure the right to vote in Mississippi ... I have never encountered or heard of another instance in the United States where armed and uniformed men blocked the entrance to a polling location."

Mr. Bull said the "clear purpose" of what the Panthers were doing was to "intimidate voters with whom they did not agree." He also said he overheard one of the men tell a white poll watcher: "You are about to be ruled by the black man, cracker."

He called their conduct an "outrageous affront to American democracy and the rights of voters to participate in an election without fear." He said it was a "racially motivated effort to limit both poll watchers aiding voters, as well as voters with whom the men did not agree."

The three men named in the complaint - New Black Panther Chairman Malik Zulu Shabazz, Minister King Samir Shabazz and Jerry Jackson - refused to appear in court to answer the accusations over a near-five month period, court records said.

Justice Department Voting Rights Section Attorney J. Christian Adams complained in one court filing about the defendants' failure to appear or to file any pleadings in the case, arguing that Mr. Jackson was "not an infant, nor is he an incompetent person as he appears capable of managing his own affairs, nor is he in the military service of the United States."

Court records show that as late as May 5, the Justice Department was still considering an order by U.S. District Judge Stewart Dalzell in Philadelphia to seek judgments, or sanctions, against the three Panthers because of their failure to appear.

But 10 days later, the department reversed itself and filed a notice of voluntary dismissal from the complaint for Malik Zulu Shabazz and Mr. Jackson.

That same day, the department asked for the default judgment against King Samir Shabazz, but limited the penalty to an order that he not display a "weapon within 100 feet of any open polling location on any election day in the city of Philadelphia" until Nov. 15, 2012.

Malik Zulu Shabazz is a Washington, D.C., resident.

Mr. Jackson was an elected member of Philadelphia's 14th Ward Democratic Committee, and was credentialed to be at the polling place last Nov. 4 as an official Democratic Party polling observer, according to the Philadelphia City Commissioner's Office.

Efforts to reach the Panthers were unsuccessful. A telephone number listed on the New Black Panthers Web site had been disconnected.

The complaint said that the three men were deployed at the entrance to a Philadelphia polling location wearing the uniform of the New Black Panther Party and that King Samir Shabazz repeatedly brandished a police-style nightstick with a contoured grip and wrist lanyard.

According to the complaint, Malik Zulu Shabazz, a Howard University Law School graduate, said the placement of King Samir Shabazz and Mr. Jackson in Philadelphia was part of a nationwide effort to deploy New Black Panther Party members at polling locations on Election Day.

The New Black Panther Party reportedly has 27 chapters operating across the United States, Britain, the Caribbean and Africa. Its Web page said it has become "a great witness to the validity of the works of the original Black Panther Party," which was founded in 1966 in Oakland, Calif.

President Obama Announces Sonia Sotomayor As His Supreme Court Nominee

As President Obama's Supreme Court nominee comes under heavy fire for allegedly being a "racist," Judge Sonia Sotomayor is listed as a member of the National Council of La Raza, a group that's promoted driver's licenses for illegal aliens, amnesty programs, and no immigration law enforcement by local and state police.

According the American Bar Association, Sotomayor is a member of the NCLR, which bills itself as the largest national Hispanic civil rights and advocacy organization in the U.S.

Meaning "the Race," La Raza also has connections to groups that advocate the separation of several southwestern states from the rest of America.

Over the past two days, Sotomayor has been heavily criticized for her racially charged statement: "I would hope that a wise Latina woman with the richness of her experience would more often than not reach a better conclusion than a white male who hasn't lived that life."

The remark was actually made during a 2001 speech at the University of California's Berkeley School of Law. The lecture was published the following year in the Berkeley La Raza Law Journal.

The comment is being zeroed in on by voices from the political right.

"I'm not saying she's a racist,but the statement sure is," columnist Ann Coulter said on ABC's "Good Morning America."

"Imagine a judicial nominee said 'my experience as a white man makes me better than a latina woman,'" blogged former House Speaker Newt Gingrich, R-Ga. "Wouldn't they have to withdraw? New racism is no better than old racism. A white man racist nominee would be forced to withdraw. Latina woman racist should also withdraw."

Radio's Rush Limbaugh noted, "And the libs of course say that minorities cannot be racists because they don't have the power to implement their racism. Well, those days are gone because reverse racists certainly do have the power to implement their power. Obama is the greatest living example of a reverse racist, and now he's appointed one. ..."

But others are suggesting Sotomayor's racial views will have little impact on her confirmation to the bench.

"She's gonna get confirmed. Get out of the way of the truck," political analyst Dick Morris said tonight on Fox News' "The O'Reilly Factor."

Host Bill O'Reilly responded, "The core conservative person ... does not understand that the GOP is shrinking and needs to expand."

The NCLR is applauding the Obama for his selection of Sotomayor.

"Today is a monumental day for Latinos. Finally, we see ourselves represented on the highest court in the land," said Janet Murguia, NCLR's president and CEO.

La Raza also praised former President George W. Bush for nominating Alberto Gonzales to succeed John Ashcroft as attorney general.

As WND previously reported, La Raza was condemned in 2007 by former U.S. Rep. Charles Norwood, R-Ga., as a radical "pro-illegal immigration lobbying organization that supports racist groups calling for the secession of the western United States as a Hispanic-only homeland."

Norwood urged La Raza to renounce its support of the Movimiento Estudiantil Chicano de Aztlan – which sees "the Race" as part of an ethnic group that one day will reclaim Aztlan, the mythical birthplace of the Aztecs. In Chicano folklore, Aztlan includes California, Arizona, Nevada, New Mexico and parts of Colorado and Texas.

It's funny that I came across this article this morning. I had recently been thinking about the rationale behind the dealership closings. It didn't make sense to me, the dealerships aren't subsidized by Chrysler and wouldn't it be better to have as many dealers as possible for public visibility. But after reading below it makes sense to me now....................( later we can talk about Obama's pressuring the chrysler bankruptcy judge to put the unsecured creditors(Autoworkers Unions) ahead of the secured creditors (bondholders). Oh & how about Obama smearing the bondholders as greedy speculators because the didn't want to take 19 cents on the dollar for their secured debt) woops I said I'd talk about that later.


Furor grows over partisan car dealer closings

Evidence appears to be mounting that the Obama administration has systematically targeted for closing Chrysler dealers who contributed to Repubicans. What started earlier this week as mainly a rumbling on the Right side of the Blogosphere has gathered some steam today with revelations that among the dealers being shut down are a GOP congressman and closing of competitors to a dealership chain partly owned by former Clinton White House chief of staff Mack McLarty.

The basic issue raised here is this: How do we account for the fact millions of dollars were contributed to GOP candidates by Chrysler who are being closed by the government, but only one has been found so far that is being closed that contributed to the Obama campaign in 2008?

Florida Rep. Vern Buchanan learned from a House colleague that his Venice, Florida, dealership is on the hit list. Buchanan also has a Nissan franchise paired with the Chrysler facility in Venice.

"It's an outrage. It's not about me. I'm going to be fine," said Buchanan, the dealership's majority owner. "You're talking over 100,000 jobs. We're supposed to be in the business of creating jobs, not killing jobs," Buchanan told News 10, a local Florida television station.

Buchanan, who succeeded former Rep. Katharine Harris in 2006, reportedly learned of his dealership's termination from Rep.Candace Miller, R-MI. Buchanan owns a total of 23 dealerships in Florida and North Carolina.

Also fueling the controversy is the fact the RLJ-McCarty-Landers chain of Arkansas and Missouri dealerships aren't being closed, but many of their local competitors are being eliminated. Go here for a detailed look at this situation. McClarty is the former Clinton senior aide. The "J" is Robert Johnson, founder of the Black Entertainment Television, a heavy Democratic contributor.

A lawyer representing a group of Chrysler dealers who are on the hit list deposed senior Chrysler executives and later told Reuters that he believes the closings have been forced on the company by the White House.

"It became clear to us that Chrysler does not see the wisdom of terminating 25 percent of its dealers. It really wasn't Chrysler's decision. They are under enormous pressure from the President's automotive task force," said attorney Leonard Bellavia.

As part of Chrysler's bankruptcy agreement with the White House, the company plans to close roughly a quarter of its 3,200 dealerships. Lists of the dealerships being cut and those retaining their Chrysler franchises can be found here in pdf format. Many dealers contend the criteria being used to determine which dealerships survive is not clear and that many of those that are being closed in fact are profitable businesses, despite the current recession.

In 34 Years of managing automobile dealerships this has to be the dumbest move in the history of our business. How can closing any dealerships HELP Chrysler one dime, it just can not happen. Dealerships do not cost the manufactures money they PAY them money up front before cars and trucks are retailed. This has to be political because on any other level it's just plain stupid. Taking a store that was worth milions 2 years ago and making it worthless is a crul move only the goverment can pull off. But to give their francsise to another dealers at no charge is criminial at a minum. You need to keep up the diligent work to find the turth, becasue the bull we have been told so far doesn't wash, there is some other real reason why they would shut down a profitable dealership and Americans deserve to know the truth. We can handle it!!!!

Targeting and destroying the livelihoods of Republican supporters while rewarding his own? Robert Mugabe and Hugo Chavez would nod their heads in approval at this Obama tactic. Small wonder that our federal republic is foundering under this president, and is about to become only a larger version of the banana republics headed by Mugabe & Chavez.

Fearsome reputation

In July 2001, the cover of Time magazine coined the phrase "Summer of the Shark" after 8-year-old Jesse Arbogast was attacked by a bull shark off Pensacola. That summer, which was not unusual in regard to the number of shark "attacks" nationwide, ended with two deaths. The species was also suspected in the Tampa Bay area's last fatal encounter, which had occurred one year earlier in Boca Ciega Bay. And that wasn't the first time bull sharks were front page news. In 1998, a 9-year-old boy was killed on Florida's east coast, and 10 years earlier, a man died after being hit in waters off Bay County. The bull was also suspected in the 1982 death of a man who had tried to swim between Anna Maria Island and Egmont Key.

By the numbers

Officially, the great white shark still tops the record books with the most attacks worldwide (232), followed by the tiger shark (86) and the bull (69). But most shark experts believe the actual number of bull shark fatalities may be much higher because many attacks occur in Third World countries and go unreported. In Florida, most shark attacks involve far less sinister species: spinner and blacktip sharks. Most "attacks" result in relatively minor injuries, and to put it in perspective, you are about three times more likely to be killed by another predator, the alligator, than a shark.

Sluggers on steroids

Pound for pound, bull sharks are the most aggressive animal on earth. The species, which can grow to 11 feet and weigh up to 500 pounds, has more testosterone than any other living creature, including tigers and lions. Veritable eating machines, these thick-bodied brutes will eat just about anything from catfish to other sharks. A favorite prey of bull sharks is tarpon. In some places, such as Boca Grande Pass, anglers are hard-pressed to land the popular sportfish in one piece, thanks to aggressive bull sharks, which have learned to associate fishermen with an easy meal.

No safe place

Bull sharks are one of the most widely distributed sharks in the world. These animals are unique because they can survive in fresh and saltwater. Bull sharks have been documented more than 2,000 miles up the Amazon and in the Mississippi above St. Louis. These beasts also have been a terror in the Ganges River of India, where they frequently attack pilgrims participating in religious ceremonies. In Central America's Lake Nicaragua, the bull shark is feared by fishermen who have lost both their catch and their friends to this fearsome predator. Since white sharks are not known to travel up rivers, and bull sharks are, most experts who have studied the "Twelve Days of Terror" think a bull shark may have been responsible for at least two of the 1916 deaths in New Jersey.

Lower the odds

Although your chances of being killed by a bull shark are less than your chances of being struck by lightning, you can take some steps to protect yourself. Here are a few tips, courtesy of the International Shark Attack File (www.flmnh.ufl.edu/fish/Sharks/ISAF/ISAF.htm):

- Avoid swimming near the mouths of rivers or bays, areas favored by bull sharks.

- Do not swim near schools of baitfish. Bull sharks may be nearby.

- When spearfishing, be ready to drop your catch. Bull sharks are attracted by speared fish.

- Avoid swimming at night or early in the morning, when sharks are most active.

An Oviedo man faces multiple charges after a weekend brawl that left two police officers injured.

Jarnell Deravious Browdy, 18, is accused of aggravated battery on an officer, battery on an officer, resisting arrest with violence and possessing cocaine, marijuana and narcotic equipment. He is being held in the Seminole County Jail in Sanford with bail set at $7,400.

The incident occurred early Saturday in the 1200 block of Harrison Street in Oviedo.

Officer Matthew DePanicis said he was patrolling when he saw an eastbound bicycle with no light on the front. DePanicis, who was joined by Cpl. Dan Sacco, said in a report that Browdy "appeared to be nervous and continued looking around and making several movements as if he was going to quickly exit off the bicycle in an attempt to flee."

At that point DePanicis spotted what turned out to be a marijuana cigar behind Browdy's left ear. He said Browdy admitted it was marijuana.

When Browdy was told he was being arrested, he began fighting the officers and trying to flee. One of his punches hit Sacco in the nose.

DePanicis said he used a stun gun on Browdy with no effect. As he tried to run, Sacco fired at him with a Taser, but only one of the two probes made contact.

Browdy continued running, while still fighting with the two officers, DePanicis said. He struck him in the legs with a baton and later on the arm, but that had little or no effect, he said.

By that time a crowd of 20 to 30 people had gathered, hovering over the officers while they yelled and screamed profanities and made threats toward them, DePanicis said. Browdy yelled "bail me out" several times to the crowd, he said. People in the crowd began shaking a fence, causing it to hit both officers in the head.

They continued to fight with Browdy until Officer Sean Snyder arrived and Tasered him in the back. It was until he applied a second charge that officers were able to get control of the man and handcuff him.

Besides being hit on the top of his head, DePanicis suffered a laceration to his left thumb.

Sacco was taken to Orlando Regional South Seminole Hospital for treatment. He suffered face, hand, knee and hip injuries, DePanicis said. The injuries to his nose caused a deviated septum, slight hairline fracture and a strong possibility of permanent nose deviation or disfigurement, he said.

This is not a headline from Chicago or Detroit, this is right here. What is wrong is that this is happening close to home. The residents virtually attack the officers, well they get the living conditions they deserve. Stop whining about crime in your hood and do something about it.

What this article doesn't tell you is that this scumbag has been doing the same thing since he was 14.

So far that's three problems/

1) Typical black neighborhood dynamics were criminals thrive and are protected

2) The court system that let's a piece of s___ walk around until he ends up killing someone

3) I wonder where his daddy is.......................
